Introduction
These Terms and Conditions govern your use of www.mittimousse.com and any order you place through it. By browsing this website, placing an order, or otherwise engaging with us, you confirm that you have read and accepted these Terms. If you do not accept them, please do not use the website or place an order.
You must be at least 18 years old and legally able to enter into a contract under Indian law to place an order. If you are under 18, you may use this website only with the involvement of a parent or guardian.

Mitti & Mousse is a patisserie founded by Urvi Solanki. We operate this website and prepare and sell the products offered on it.

In these Terms, “we”, “us” and “our” refer to Mitti & Mousse. “You” and “your” refer to the person using the website or placing an order.
We are a delivery-only business. Our kitchen is not a shop and is not open for walk-in customers or collections unless specifically arranged in advance in writing.
Our products
Everything is made fresh to order. We do not hold finished stock. Each cake is prepared for a specific customer and a specific delivery date.
Our products are perishable. They are made without commercial preservatives and have a short life. Storage guidance is given below and on each product page.
Our products are handmade, so no two are identical. Photographs on the website and on our social media are representative. Colour, decoration, garnish and finish will vary between cakes, and seasonal ingredients vary in appearance through the year. We will always match the flavour, size and components described on the product page, but we cannot guarantee an exact visual match to a photograph.
Substitution. Occasionally an ingredient may be unavailable or below the standard we accept. Where that happens we will substitute a comparable ingredient of equal or better quality, and will tell you in advance where the change is material.
Availability. Products listed on the website may be withdrawn, changed or made seasonally available without notice. Berry and fruit garnishes in particular vary with seasonal supply.
Allergens and dietary information
Please read this section carefully.
Our kitchen handles nuts, tree nuts, dairy, wheat, gluten, soy and other allergens. We cannot guarantee that any product is free from traces of any allergen, regardless of how it is described, because all products are prepared in the same kitchen using shared equipment.
If you or the recipient has a serious allergy or intolerance, please contact us before ordering and we will tell you honestly whether we can safely meet the requirement. We may decline an order where we cannot do so.
Vegan is not gluten free. Our vegan entremets are made without dairy or egg but contain wheat flour. Please do not read one claim as the other.
Ingredient and component information for each product is given on its product page. Where you have told us about a dietary requirement, we will do our best to accommodate it, but it is your responsibility to check the ingredient information for every order — recipes and suppliers change. Where you are ordering for someone else, it is your responsibility to make them aware of the ingredients.
Placing an order
An order is placed when you complete checkout and payment on the website, or when you confirm an order with us over WhatsApp or email and payment is received. An order is accepted only when we send you a confirmation. Until then, no contract exists between us.
We may decline or cancel an order at our discretion, including where:
- the product is unavailable, or capacity for that date is full
- there is an error in the price or product description
- the delivery address is outside our delivery area, incomplete or unclear
- we cannot safely meet a stated dietary requirement
- we suspect fraudulent or abusive use
- the requested lead time is too short to make the product properly
Where we decline or cancel, we will tell you and refund any amount you have paid in full.
Lead times. Orders require a minimum of 48 hours’ notice. Custom orders require longer, agreed with you at the time of enquiry. This is not administrative — layered mousse cakes require setting time and cannot be made faster without a loss of quality.
Accuracy of your information. Please check your order carefully before confirming: flavour, size, delivery date, delivery address, recipient name, contact number and any message text. We prepare what is on the confirmed order. We cannot take responsibility for errors in information you have supplied, including misspelt names on message cards.
Pricing and payment
All prices are shown in Indian Rupees and include GST at the applicable rate. Delivery charges, where applicable, are shown separately at checkout before payment.
We accept the payment methods shown at checkout. Payment is taken in full at the time of order, unless we have agreed otherwise with you in writing for a corporate or bulk order.
Pricing errors. We take care with pricing, but errors occur. Where a product has been listed at an incorrect price, we are not obliged to supply it at that price. We will contact you to confirm whether you wish to proceed at the correct price, or cancel and refund you in full. Prices may change at any time without notice. The price that applies to your order is the one shown at the time your order is confirmed.
Payment processing. Payments are handled by third-party payment providers. We do not store your card details. Your use of a payment method is also subject to the terms of your card issuer or bank, and we are not a party to that relationship.
Failed payments. If a payment fails but an amount is debited from your account, it is normally reversed by your bank within seven to ten working days. Please contact your bank in the first instance, and let us know so we can assist.
Changes and cancellations
Because every product is made to order, our cancellation terms are tied to when production begins.

Changes to an order — flavour, size, date, address — can be made up to 48 hours before delivery, subject to availability. After that we may not be able to accommodate a change.
How to cancel or change: contact us on +91 90825 71880 or hello@mittimousse.com, quoting your order number. A cancellation takes effect when we acknowledge it, not when you send the message.
Refunds are made to the original payment method within seven to ten working days of being approved. Timing thereafter depends on your bank.
Delivery
Where we deliver: Mumbai, Navi Mumbai and Thane. If your area is not covered, message us on +91 90825 71880 before ordering — we can sometimes arrange delivery slightly outside our usual zones at additional cost, but not always.
Delivery slots. You select a delivery date and time window when you order. We will do everything reasonable to deliver within that window, but slots are indicative and not guaranteed. Traffic, weather, road closures and festival restrictions are common in Mumbai and outside our control.
Someone must be available to receive the order. Our products are perishable and temperature-sensitive. They cannot be left at a doorstep, with a security guard, in a lobby, or with a neighbour unless you have instructed us in writing to do so — and where you do, risk passes to you at that point.
Failed delivery. If we cannot complete a delivery because nobody is available, the address is incorrect or incomplete, the contact number is unreachable, or access is refused, we will attempt to contact you on the number provided. Where a delivery fails for these reasons, the order is treated as fulfilled and no refund is due. A redelivery, if possible, will be charged.
Deliveries to third parties. Where you are sending an order as a gift, you are responsible for providing accurate recipient details. Delivery to the recipient constitutes delivery to you. Risk and title in the product pass to you, or to the recipient, on delivery.
Force majeure. We are not liable for delay or failure to deliver caused by events beyond our reasonable control, including extreme weather, flooding, monsoon disruption, strikes, civil unrest, road or area closures, public holidays and festival restrictions, power or utility failure, supplier failure, government order, or public health measures. Where such an event prevents delivery, we will contact you to reschedule or refund.
Returns and refunds
Our products are perishable food items and cannot be returned or exchanged once delivered. This is standard for freshly prepared food and is for reasons of food safety. This does not affect your rights where a product is defective, materially different from what was ordered, or not of the quality you are entitled to expect.
If something is wrong with your order:
- Contact us on +91 90825 71880 on the day of delivery
- Send clear photographs of the product, including the packaging as received
- Retain the product and packaging until we have responded — we may ask to collect it
We will assess each case on its facts and, where we are at fault, offer a replacement, a partial refund or a full refund, in discussion with you.
We are unlikely to be able to help where:
- the issue is reported more than 24 hours after delivery
- the product has been consumed in substantial part
- the storage guidance below was not followed
- the complaint relates to a variation in appearance, colour or decoration of the kind described above
- the complaint relates to personal taste preference rather than a defect
We are a small kitchen and we would far rather hear about a problem than not. Please tell us.
Storing and serving your order
Once a product has been delivered, its condition depends on how it is stored. Please follow the guidance supplied with your order and on the product page. In general:
- Refrigerate immediately on receipt, at 2–4°C, in the box provided
- Do not freeze. Our products have already been set and thawed
- Consume within 48 hours of delivery
- Remove from refrigeration 15 to 20 minutes before serving — no longer in warm weather
- Keep away from strongly scented foods; mousse absorbs odours
We cannot accept responsibility for deterioration in quality or safety resulting from improper storage or handling after delivery.
Custom and bespoke orders
- Custom orders are designed and priced individually. A quotation is valid for 14 days and is based on the specification agreed at the time
- Full payment is required to confirm the order
- Custom orders are non-cancellable and non-refundable once confirmed, as the work cannot be resold
- Design references you supply are used as inspiration. We do not produce exact copies of another bakery’s work, and the finished cake is our interpretation
- Where you supply artwork, logos or images, you confirm that you have the right to use them and that they do not infringe anyone’s intellectual property. You indemnify us against any claim arising from their use
Corporate and bulk orders
Corporate, bulk and gifting orders are subject to separate terms confirmed in writing at the time of order, including minimum quantities, lead times, payment schedule and cancellation terms. Where those terms conflict with these Terms, the written order confirmation prevails.
Promotional codes and offers
Promotional codes are issued at our discretion and may be limited by time, quantity, product or customer. They cannot be exchanged for cash, sold or transferred, and cannot be combined with other offers unless stated. We may withdraw or vary an offer at any time. Where an order is cancelled or refunded, any promotional code used may not be reissued.
Use of this website
You may use this website for lawful personal purposes only. You agree not to:
- use the website for any fraudulent, unlawful or abusive purpose
- interfere with, disrupt, or attempt to gain unauthorised access to the website or its systems
- introduce any virus, malicious code or harmful material
- copy, reproduce, scrape, republish or exploit any part of the website or its content without our written permission
- use our name, logo, marks or imagery in any way that suggests an association or endorsement that does not exist
- resell our products without our written consent
We may suspend or restrict your access to the website, or decline to accept orders from you, where we reasonably believe these Terms have been breached. We do not guarantee that the website will be available uninterrupted or free of errors, and we may change, suspend or withdraw any part of it without notice.
Intellectual property
All content on this website — including the Mitti & Mousse name, the ampersand mark, logos, photography, product names, recipes, descriptions, design and copy — is owned by us or licensed to us, and is protected by law. You may not reproduce, distribute or use any of it commercially without our prior written consent.
Reviews, photographs and content you share
Where you share a review, comment, photograph or video with us — including by tagging us or using our handle on social media — you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and display that content in our marketing, on our website and on our social media channels, with credit where practicable.
You confirm that you own or have the right to share the content, and that it does not infringe anyone else’s rights. If you would prefer we did not use something you have shared, contact us and we will remove it. We may remove or decline to publish any content at our discretion.
Third-party links
This website may link to third-party sites or services. We do not control them and are not responsible for their content, availability or practices. Following such a link is at your own risk.
Disclaimers and limitation of liability
The website and its content are provided on an “as is” basis. To the extent permitted by law, we exclude all warranties not expressly set out in these Terms.
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be limited or excluded — including under the Consumer Protection Act, 2019 and the Food Safety and Standards Act, 2006.
Subject to that, our total liability in connection with any order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses, including loss of enjoyment, disappointment, loss of profit, or costs arising from an event not proceeding as planned.
Indemnity
You agree to indemnify us against any claim, loss, liability or expense arising from your breach of these Terms, your misuse of the website, or your infringement of any third party’s rights.
Grievance redressal
In accordance with the Information Technology Act, 2000 and the Consumer Protection (E-Commerce) Rules, 2020, our Grievance Officer is:

We will acknowledge a complaint within 48 hours of receipt and aim to resolve it within one month.
Governing law and jurisdiction
These Terms are governed by the laws of India. Any dispute arising out of or in connection with them, or with any order, is subject to the exclusive jurisdiction of the courts at Mumbai, Maharashtra.
Changes to these Terms
We may update these Terms from time to time. The version in force is the one published on this page, and the “Last updated” date above shows when it last changed. Changes do not apply retrospectively to orders already confirmed. Continuing to use the website after a change means you accept the updated Terms.
General
Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions continue in effect.
No waiver. If we do not enforce a right under these Terms, that is not a waiver of it.
Entire agreement. These Terms, together with our Privacy Policy, Shipping & Delivery Policy and Refund & Cancellation Policy, form the whole agreement between us in relation to your use of the website and your orders.
